Terms and Conditions

These Terms and Conditions apply to all purchases and supply arrangements made with Container Market SA (“we”, “us”, “our”). By placing an order, you (“you”, “customer”) agree to these terms.

Who We Are & What We Supply

Container Market SA provides practical container and portable solutions, including:

  • Shipping Containers (General Purpose and Hi Cube) for storage and logistics
  • Portable Buildings (offices, workshops, site facilities)
  • Portable Homes, Shipping Container Homes, Expandable Container Homes
  • Bathrooms and Toilets for remote sites
  • Container Frames, Shipping Container Domes, Deck Pods
  • Flat Pack and DIY units
  • Dangerous Goods Shipping Containers (for suitable regulated storage applications)

Quotes, Pricing & VAT

  • All prices are in South African Rand (ZAR).
  • VAT inclusion/exclusion will be stated on your quote/invoice.
  • Quotes are valid for the period stated on the quote (or otherwise a reasonable period).
  • If a pricing or listing error occurs, we may correct it and will contact you to confirm the correct pricing before proceeding. If you do not accept the correction, you may request a refund for amounts paid.

Orders, Payment & Confirmation

  • An order is confirmed when we receive written acceptance of the quote and payment (or deposit) reflects as cleared, unless otherwise agreed in writing.
  • We may request additional information to confirm specifications, access requirements, or delivery details before finalising the order.

Product Descriptions, Grades & Suitability

We aim to provide clear, honest descriptions and guidance.

  • Containers may be new or used and may show signs of prior use depending on the agreed grade/condition.
  • Cosmetic wear consistent with the agreed description is not a defect.
  • You are responsible for confirming suitability for your intended use (storage, logistics, accommodation, regulated storage). We will provide guidance based on the needs you share with us.

Compliance, Approvals & Installation Responsibility

For portable buildings, portable homes, and container homes, you are responsible for:

  • site preparation (base/foundation, drainage, access),
  • municipal approvals, zoning, and building compliance where required,
  • utility connections (electrical, water, sewer) and compliance with applicable regulations,
  • safe use and ongoing maintenance.

Delivery, Risk & Ownership

Delivery is governed by our Shipping Policy.

  • Ownership may remain with Container Market SA until full payment clears.
  • Risk generally passes on delivery/acceptance, subject to rights under the CPA.

Cancellations & Changes

If you cancel or request changes after confirmation, you may be liable for reasonable costs already incurred, including preparation, transport booking, or work completed. Customised or modified units may have limited cancellation options once work has started.

Limitation of Liability

To the extent permitted by law:

  • we are not liable for indirect or consequential losses (such as loss of profits or business interruption),
  • our liability is limited to the amount paid for the relevant goods/services, unless the CPA requires otherwise.

Consumer Protection Act (CPA)

Nothing in these Terms and Conditions limits any rights you may have under the Consumer Protection Act, 2008, where applicable.
